DUI:  First Offender Minimum Penalties

1. Mandatory conviction for DUI (misdemeanor offense).

2. One year supervised probation.

        a. Meet with probation officer once a month

        b. Pay monthly supervision fee (about $50.00 per month).

3. $500 fine plus court costs

        a. If your breath test results are >.15 the minimum fine is $1000

        b. If a person under 18 is in the vehicle at the time of the offense the mimum fine is $1000

4. $50 costs of prosecution

5.  Attend Alcohol Safety Education Course (DUI School).

        a. Cost of DUI School: $225.00

        b. At least 12 hours of class time.

        c. Possible additional counseling for twelve weeks (one hour/week + $20.00 weekly fee).

6.  Attend Victim Impact Panel.

7.  Six months suspension of driver’s license from date of conviction.

        a. Eligible for hardship license if DUI school is completed.

8.  Ten day impoundment of vehicle.

9.  Most counties will require no possession or consumption of alcohol or drugs with random screens

10.  Most counties will require a substance abuse evaluation and completion of recommended treatment
